These Terms of Use ("Terms") govern your use of the mobile application Luaro (the "App", “Application”, “Services”, “Service”), operated by Yaroslav Lishchynskyi (“the developer”, "we", "us", or "our"). These Terms constitute the entire agreement between the developer and you (“user”).

⚠ Please read carefully By downloading and using the Service, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree, you must discontinue use immediately.

Intellectual Property Rights

The Application — including its source code, design, user interface, text, and overall structure — is owned by Yaroslav Lishchynskyi and is protected by applicable copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes. You are not permitted to:

  • Copy, modify, or create derivative works of the Application.
  • Reverse engineer, decompile, or attempt to extract the source code.
  • Sell, sublicense, or otherwise exploit the Application or any part of it without prior written permission.

All trademarks, service marks, and trade names used in the Application are the property of their respective owners. The name, logo, and branding of the Application are protected under applicable laws.

User Conduct & Prohibited Activities

By using the Application, you agree not to engage in any of the following:

  • Illegal Use: Using the Application for any illegal or unauthorized purpose, or in violation of local, national, or international laws.
  • Interference: Disrupting the integrity or performance of the Application, or attempting to gain unauthorized access to our systems or related networks.
  • Harmful Software: Uploading, transmitting, or distributing viruses, malware, or any software intended to damage or alter a computer system or data.
  • Automated Access: Using bots, crawlers, or scripts to access the Application or extract data without express written permission.
⚠️ Any violation of these rules may result in suspension or termination of access, to the extent permitted by applicable law.

Payments & Subscriptions

Some features require a paid subscription. All purchases are processed through Apple's App Store and are subject to Apple's payment terms.

  • Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription at any time through your Apple ID account settings.
  • All payments are non-refundable, except as required by applicable law or Apple policies. The developer does not control billing or refunds — contact Apple Support directly for refund requests.

🎁 We offer a 7-day free trial for certain plans, available once per Apple ID. If you do not cancel at least 24 hours before the trial ends, your subscription will automatically renew at the full price.

Disclaimer of Warranties

The Application is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, the developer disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Application will be uninterrupted, error-free, secure, or bug-free, nor do we guarantee that defects will be corrected.

ℹ️ The Application is designed to support users in managing their digital habits. We do not guarantee any specific outcomes — such as reduced screen time, improved focus, or behavioral change. Such results depend on factors outside our control, including individual behavior and consistency of use.

Limitation of Liability

To the fullest extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, loss of data, or other intangible losses — arising from your use of or inability to use the Application.

  • The developer is not liable for damages resulting from interruptions, errors, bugs, or security vulnerabilities.
  • The developer is not responsible for outcomes related to user behavior, including failure to reduce screen time or change habits.
  • The developer is not liable for errors caused by iOS updates or changes to Apple's Screen Time API or Family Controls policy.
  • The developer is not responsible for consequences resulting from restrictions you have configured yourself.

In no event shall the developer's total liability exceed the amount you have paid (if any) for access to the Application within the twelve (12) months preceding the claim. Some jurisdictions do not allow certain liability exclusions, so some limitations may not apply to you.

No Professional Advice

The Application is a productivity and time-management tool. By using it, you acknowledge that:

  • Not a Medical Service: The Application does not provide medical, psychological, or health advice, diagnosis, or treatment.
  • Informational Only: Any information, suggestions, or features (such as screen time statistics or focus tips) are for informational purposes only.
  • No Professional Relationship: Your use of the Application does not create any professional relationship between you and the developer.
  • Consult a Professional: If you are experiencing severe symptoms of digital addiction, anxiety, or other health issues, seek advice from a qualified professional.
  • Individual Responsibility: You are solely responsible for how you interpret and use the information provided by the Application.

Force Majeure

The developer shall not be liable for any failure or delay in performing obligations due to causes beyond our reasonable control, including:

  • Acts of God, natural disasters, or severe weather.
  • War, terrorism, civil unrest, or government action.
  • Pandemics or public health emergencies.
  • Failures of third-party services or infrastructure (including Apple's services).
  • Changes to iOS, App Store policies, or Apple's APIs.
  • Internet or telecommunications failures.

User Responsibility for Restrictions

The Application allows you to configure restrictions and unlocking conditions to limit access to selected apps or features. You are solely responsible for choosing and managing these settings.

🔧 The developer shall not be liable for any inconvenience or loss of access resulting from restrictions or unlocking conditions that you have configured. All restrictions are user-controlled and can be modified through available system settings or within the Application.

Third-Party Services & Links

The Application may contain links to third-party websites or services not owned or controlled by the developer. The developer assumes no responsibility for the content, privacy policies, or practices of any third-party service. Inclusion of any link does not imply endorsement.

You access third-party websites and services at your own risk and should review their respective terms and privacy policies.

Permissions & System-Level Access

To provide its core functionality, the Application requires authorization to access screen time–related features through system-level APIs. By using the Application, you agree to grant the necessary permissions when prompted.

If you deny, restrict, or later revoke these permissions, some or all features may become unavailable. The Application's functionality is inherently dependent on system frameworks managed by Apple Inc. and may be affected by changes to the operating system, device settings, or user permissions.

Technical Requirements

The Application requires a compatible Apple device and a supported version of iOS to function properly. Minimum requirements:

The Application may not function properly on beta versions of iOS or jailbroken devices. We do not provide support for unsupported configurations.

Governing Law

These Terms shall be governed by the laws of the Republic of Poland, without regard to its conflict of law principles. Any disputes shall be subject to the jurisdiction of the competent courts of the Republic of Poland, unless otherwise required by applicable consumer protection laws.

🇪🇺 If you are a consumer residing in the European Union, you may also benefit from any mandatory provisions of the law of the country in which you reside.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary. The remaining provisions will remain in full force and effect. Failure of the developer to enforce any right or provision will not be deemed a waiver of such right or provision.

Your use of the Application is also governed by our Privacy Policy, available at luaro.privacy.app.

App Updates & Changes

We constantly work to improve the Application and may provide updates, bug fixes, or new features from time to time.

  • Automatic Updates: Depending on your device settings, the Application may automatically download and install updates.
  • Changes to Functionality: We reserve the right to modify, suspend, or discontinue any part of the Application at any time, with or without notice.
  • Compatibility: Some updates may require you to update your device's operating system or hardware. We do not guarantee compatibility with all devices or OS versions.
  • Changes to These Terms: We may update these Terms at any time. Your continued use after changes take effect constitutes acceptance of the new Terms. If you do not agree, you must stop using the Application immediately.
